Consumer Terms of Service

These Terms of Service ("Terms") govern your access to and use of Zerophia's services, including our website, applications, and other products and services ("Services") provided by Zerophia ("we," "us," or "our").
1. Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent that you meet this requirement and that you have the right, authority, and capacity to agree to these Terms.
2. Acceptable Use
When using our Services, you agree not to:
- Use the Services in any way that violates applicable laws or regulations
- Use the Services to harm, threaten, or harass any person or to incite violence
- Attempt to gain unauthorized access to any part of the Services
- Interfere with the proper functioning of the Services
- Impersonate or attempt to impersonate Zerophia, a Zerophia employee, or another user
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
3. Intellectual Property Rights
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Zerophia, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms do not grant you any rights to use the Zerophia name, logo, or any other trademarks, service marks, or product and service names.
4. User Content
Our Services may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, videos, or audio ("User Content").
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing the Services.
5. Privacy
Please review our Privacy Policy, which also governs your use of the Services and explains how we collect, use, and protect the information you provide to us.
6. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
7. Changes to Terms
We may revise these Terms from time to time at our sole discretion. All changes are effective immediately when posted, and your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

ZEROPHIA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEROPHIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.
10. Governing Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of California, in each case located in the City of San Francisco, and you and Zerophia irrevocably submit to the jurisdiction of such courts in respect of any such action or proceeding.
